These Terms of Service ("Terms") constitute a legally binding agreement between you and Encore Systems LLC, a Minnesota limited liability company with its principal place of business in Burnsville, Minnesota. These Terms govern your access to and use of the ConcertHub web application, mobile application, and all related services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Overview of the Service
ConcertHub is a mobile platform provided by Encore Systems LLC that enables music fans to discover concerts and add music to their streaming libraries, and allows bands to register concerts and share setlists. The Service includes integrations with third-party platforms such as Spotify and Apple Music, which facilitate music library functionality and artist verification.
2. User Types
There are two categories of users on the Service:

Bands: Individuals or entities who register with ConcertHub to manage and promote concerts. Bands are required to verify their identity using Spotify.

Fans: Individuals who use the application to explore concerts and add music to their personal streaming libraries. Fans are not required to create a ConcertHub account.
3. Eligibility
The Service is available to users of all ages. However, access to certain features may require linking an active Spotify or Apple Music account. By using these integrations, you agree to comply with the respective terms and conditions of those third-party services.
4. Third-Party Integrations
The Service may offer functionality that connects with services provided by third parties, including but not limited to:

By connecting a third-party service, you grant Encore Systems LLC the right to use certain information from your linked account solely for the purposes of providing the features of the Service. No personal listening data is collected or stored by Encore Systems LLC.
5. Data Collection and Location Services
Encore Systems LLC does not collect or store data from your Spotify or Apple Music accounts beyond what is necessary for Service functionality. Usage data related to concerts is collected only in aggregate, anonymized form and is not tied to individual user identities. Location services may be used to suggest concerts near your current location. The Service does not record or store your location data.
6. Email and Mailing Lists
When a fan chooses to "follow" a band through the Service, their email address is provided to that band. The band may use the email address for direct marketing or other communications, subject to applicable laws. Encore Systems LLC does not manage mailing lists and is not responsible for their content or operation. To unsubscribe from a band's mailing list, users must follow the instructions provided by the band. Bands are encouraged to use email marketing tools that comply with applicable laws, including the CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), and the General Data Protection Regulation (GDPR).
7. User-Generated Content
Bands may submit concert-related content, including but not limited to descriptions, setlists, and commentary. Encore Systems LLC may establish guidelines for acceptable content, and reserves the right (but not the obligation) to remove or restrict content that violates these guidelines or applicable laws. Content moderation may be limited.
8. External Links
The Service may contain links to third-party websites, services, or platforms—including but not limited to social media sites and online stores. These external sites are not operated or controlled by Encore Systems LLC, and your interactions with them are entirely outside the scope of the Service. Encore Systems LLC is not responsible for the content, terms, policies, or practices of any third-party service. Your use of any third-party site is governed by that site’s own terms and policies.
9. Termination and Account Management
Fans do not create individual accounts with Encore Systems LLC, and as such, may stop using the Service at any time by deleting the application and unlinking their streaming services. Encore Systems LLC reserves the right to suspend or terminate access to the Service for any user who violates these Terms or otherwise engages in activity that disrupts or harms the platform.
10. Modifications to Terms
Encore Systems LLC reserves the right to modify or update these Terms at any time. Any changes will be posted in the application and reflected with a new “Effective Date.” Your continued use of the Service after any such modification constitutes your acceptance of the updated Terms.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis. Encore Systems LLC makes no warranties or representations, express or implied, regarding the accuracy, reliability, availability, or suitability of the Service for any particular purpose. To the fullest extent permitted by law, all warranties are disclaimed. Encore Systems LLC is not responsible for the accuracy of any user-submitted content or third-party service functionality.
12. Limitation of Liability
The Service is provided on an “as is” and “as available” basis. Encore Systems LLC makes no warranties or representations, express or implied, regarding the accuracy, reliability, availability, or suitability of the Service for any particular purpose. To the fullest extent permitted by law, all warranties are disclaimed. Encore Systems LLC is not responsible for the accuracy of any user-submitted content or third-party service functionality.
